An "attorney state" is a U.S. state real estate law requires a licensed attorney to be involved in the closing process of a real estate transaction. The role of the attorney can vary by state, but they typically provide legal advice, ensure compliance with state laws, serve as escrow agent to safeguard money to be paid by the buyer to the seller, and help resolve any legal issues that may arise during the transaction.
In a "title state" or "escrow state" title companies can handle closings without requiring an attorney's involvement. In title states, parties (i.e. buyer and/or seller) can choose to have an attorney represent them during the transaction.
